BASILAR FESTIVAL “TERMS & CONDITIONS”
Promoter details
Minuto Melómano LDA
NIF: PT517963035
1. Tickets are sold for the event by the organisation called Minuto Melómano Lda (the ‘Promoter’), subject to licence approval, the terms and conditions below, and the rules and regulations of Basilar Festival (the ‘Festival’), as displayed at the venue (the ‘Site’).
2. Without prejudice to the rules applicable to any person within the festival site, and for the avoidance of any doubt, the person who purchases the tickets (the “buyer”) is the only one considered a contractual party to whom the promoter has any obligations under the purchase agreement settled between the parties.
3. These Terms & Conditions contain important information; please read them carefully. The use of this ticket and entry onto the Site shall constitute an acceptance by the buyer and holder (meaning the person who is in possession of the ticket) of these Terms & Conditions and implies an undertaking on the part of the buyer and holder to observe them. In the event of any breach of these Terms & Conditions, the promoter reserves the right to cancel tickets, to refuse admission, to remove the holder or to confiscate offending items, as the case may be, and in any case, to retain any money paid for the relevant ticket.
4. Tickets are nominative and non-refundable. The identity of the ticket holder will be verified at check-in. A valid photo identification document must be presented and must correspond to the name indicated on the ticket. The resale of tickets for commercial purposes or for profit, outside channels officially authorised by the Promoter, is strictly prohibited and will render the ticket void. In such cases, the ticket holder may be refused entry or removed from the Site without entitlement to any refund.
5. The Festival is classified as 16+. Age verification will be carried out at check-in, and attendees must present a valid identification document upon request. The Promoter reserves the right to refuse entry to any person who does not meet the age requirement, without entitlement to any refund.
6. Tickets may not be used for contests, promotions, or hospitality packages without the Promoter's prior written consent. Any ticket used in this manner will become voidable, and the holder may be refused entry or removed from the Site.
7. The Promoter reserves the right to make changes to the Festival programme, including artists, schedules and other elements of the event, provided that such changes do not substantially alter the essential nature of the Festival. Changes to the programme, including artist substitutions, do not in themselves entitle the ticket holder to a refund, except where required under applicable law.
8. Official Festival wristbands must be worn at all times while on the Site. If a wristband becomes damaged and is at risk of falling off, the ticket holder must immediately go to the ticket office to request a replacement. The damaged wristband must still be attached to the wrist at the time of replacement. Lost or removed wristbands will not be replaced, and access to the Site may be refused. If you do not wear a wristband, or if you wear a tampered wristband, you will be escorted out of the Site.
9. Lost, stolen, damaged, destroyed or undelivered tickets cannot be replaced or refunded. There will be no admission without a valid ticket. When you receive your tickets, please check them carefully, as mistakes cannot always be rectified. Keep tickets in a safe place.
10. The Promoter reserves the right to refuse admission to the Festival. Stewards and security personnel will conduct searches of persons entering the Site to ensure the safety of the other participants.
11. Any person who fails to comply with instructions from a steward or other person acting for the Promoter or behaves against the peaceful atmosphere at the Site and its close surroundings may be removed from the Site.
12. Admission to and presence at the Site are at the ticket holder’s own risk, taking into account the natural characteristics of the location where the Festival takes place, including forested areas, uneven terrain and other natural features. The Promoter shall not be liable for loss of or damage to personal property occurring at the Site, except where such loss or damage results from wilful misconduct or negligence legally attributable to the Promoter.
13. The Festival takes place outdoors and is subject to weather and environmental conditions, including but not limited to heat, rain, wind, mud, dust and temperature variations. Such conditions may affect comfort, visibility or movement within the Site and do not constitute grounds for a refund, except where otherwise required by applicable law. Ticket holders are responsible for preparing accordingly and for taking appropriate precautions for their own health and safety.
14. No bottles, cans, glass, containers or alcohol are allowed on the festival site. Chairs (except for folding chairs), tables or picnic equipment can only be brought onto the campsite. Glass bottles or containers increase the risk of fire and are harmful to nature if left behind; they are not allowed. Any of these items found will be confiscated.
15. The festival takes place in early September, in a forest area, so the risk of fire is still high. Therefore, it’s not allowed to make fires of any kind. Cigarette butts should be carefully put out at all times. Keep the land clean and don’t litter. Any person who litters may be refused entry or asked to leave the Site.
16. No illegal substances may be brought onto the Site. Please respect your health and your limits.
17. Official merchandise, food and drinks will be available from authorised identified vendors within the Site. No vending can be undertaken without the prior written consent of the Promoter. Any offenders will have their property confiscated and may be asked to leave the Site.
18. Photographic, video or audio reproduction of Basilar Festival is prohibited for commercial purposes. You can share some videos and photos on your personal social media channels if the privacy of festival attendees is respected.
19. Ticket buyers and ticket holders acknowledge and agree that photographic, audio and audiovisual recordings may be made during the Festival in which they may appear as members of the audience, for the purposes of promotion and communication of the Festival.
20. No animals are allowed on the Site, except for guide dogs for the visually impaired. Sun exposure, dehydration, noise and crowds may cause stress and health risks to animals; therefore, pets are not permitted at the Festival.
21. Basilar Festival is a space dedicated to music, nature and community. All attendees are expected to treat others with respect, regardless of race, gender, age, background or sexual orientation. Behaviour involving racism, homophobia, harassment, aggression, violence or any form of discrimination will not be tolerated and may result in immediate removal from the Site.
22. Basilar Festival welcomes attendees with disabilities. Please note that the Festival takes place in a natural outdoor environment, and certain areas of the Site may include terrain or conditions that could make access challenging. One complimentary ticket will be provided for a caretaker or helper accompanying a disabled attendee. Attendees requiring accessibility support or caretaker access must contact the Promoter in advance via geral@basilarfestival.com, subject to availability and verification.
FORCE MAJEURE
In the case of circumstances beyond normal control, such as war, civil or political unrest, actions and orders from the authorities, strikes, catastrophes, epidemics, unfavourable weather conditions or other serious damages or highly unexpected factors, the Promoter may cancel the Festival, and the amounts received may not be refunded.
If there is an interruption of the event and/or replacement of the program or activity of the festival resulting from the occurrence of a situation of extraordinary/unforeseeable nature outside the will of the organisers, the tickets may not be refunded.
SEVERABILITY
If any provision of these Terms & Conditions is held to be invalid, unlawful or unenforceable by a competent authority or court, such provision shall be deemed severed, and the remaining provisions shall remain in full force and effect.
